Article 9 of the GDPR

Article 9 of the GDPR (Special Categories of Personal Data)

Article 9 of the GDPR provides extra protection for particularly sensitive types of personal data because misuse of this information could significantly affect an individual’s rights and freedoms. It generally prohibits the processing of data that reveals a person’s racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic data, biometric data used for identification, health information, or information about a person’s sex life or sexual orientation.

However, processing is allowed in certain situations, such as when the individual has given explicit consent, when it is necessary for employment or social security obligations, to protect someone’s vital interests, for medical or public health purposes, or where there is another lawful exemption set out in the GDPR. Organisations processing this type of data must apply strong safeguards and ensure the processing is lawful, necessary, and proportionate.
